Motor Vehicle Accident FAQs

In Alberta, you typically have two years from the date of a motor vehicle accident to begin a lawsuit. If you miss that deadline, you lose your legal right to pursue compensation through the courts. Alberta has also introduced Bill 47, the Automobile Insurance Act, which is scheduled to take effect on January 1, 2027. Once in force, this new Care-First insurance system will significantly restrict the ability to sue an at-fault driver for most injury claims.

You can still recover compensation. Alberta's contributory negligence rules mean your award is reduced by your percentage of fault — not eliminated.

Not necessarily. Alberta's Minor Injury Regulation caps soft tissue claims at $6,061 — but injuries causing substantial impairment, neurological symptoms, or fractures are excluded from the cap. Ajay is experienced at arguing your injury falls outside this limit.
